WP Number, WP 13823 of 2023 has been issued for the Writ Petition. Form c was issued by PIP committee.
Office objections listed by the ‘Scrutiny branch’ were addressed by me. Here are some of the remarks. I filled the Form-A with tick marks indicating that I ‘intend to argue my case in-person, in case W.P. No. FR No. 13887/2023 as petitioner’. I made the requested correction in Form B. Changed ‘[See sub-rule (2) of Rule 8]’, to ‘See sub-rule (e) of Rule 8]’. This is according to the latest version of the Form B. At the end of the Writ petition, I was asked to write ‘Address for service’ for any communications / correspondence. I gave the address listed in my passport. I gave my written responses / submissions for the Office objections from 1 to 11.

The Honorable court cited that some office objections must be complied with, and posted the petition for hearing on 4-8-2023.
Activity on 12-7-2023.
Met the ‘Scrutiny branch’ to discuss what other office objections were pending. I was asked to give ‘clear headings’ for PRAYER and INTERIM PRAYER. I made the corrections and signed approving the corrections. I was asked about Memorandum under order XXVII rule 6, pages 41-43. I made a written submission that it is a Memo to be recorded by the Honorable court.
Activity on 15-7-2023.
Scrutiny branch cited objections to be rectified. That I must furnish ‘grounds for Interim prayer’. And also sequence the Prayer / Interim Prayer correctly.
Activity on 17-7-2023.
I filed the attached ‘Memorandum for production of additional documents’ with Annexures E1, G1, J1, M1, and W1, with the Honorable High Court of Karnataka.
I included details ‘grounds for interim prayer’, and sequenced Prayer / Interim Prayer to comply with cited office objections. Sheets 22-40 were replaced. The replaced sheets 22-40 are attached here. The office reviewed the petition and concluded that all office objections were complied with.
Activity on 18-7-2023.
I filed ‘Memorandum for posting’ with the Honorable court, stating that I have complied with all the office objections, and the petition must be posted for preliminary hearing. The Honorable court posted it for ‘Preliminary hearing’ on 31-7-2023.

Due to roster change and court change, the petition was not on cause list for 31-7-2023. I filed a ‘Memo for posting’ in CH-27 on 31-7-2023 afternoon. Writ was posted for hearing on 3-8-2023.

I shared with the Honorable court that I have attached all the documented evidence for the requested Interim prayer orders Q to FF, and orders for prayer points A to F. Respondent was asked to file if they have any objections before 11-8-2023. The Writ petition is posted for further hearing on 11-8-2023.

I mentioned to the Honorable court that I would need few hours spread over few days to present the entire WP. The Honorable court asked the respondent to give a written response / objections if they have any, to exhaust the time that must be given to them. Further, the Honorable court clearly indicated that I was in the court for a genuine cause of action, and that they are with the law and with Union of India. The WP is posted for hearing on 4-9-2023. On the upcoming hearing date, I shall be presenting the status of WP 12356/2023 to the Honorable court, that I am looking to receive orders for the issue of ‘consent letter’, and also present few relevant annexures.

Activity on 4-10-2023
I filed the following Memorandum for production of additional documents, Annexure F1, with the Honorable court on 4-10-2023. This has some extremely important information regarding introducing the Macro-Economic reform, the relevance of getting the liability wealth into India for investment, contribution towards progress of science and technology, which is inline with Preamble of Patent Cooperation Treaty. I request WIPO, all the world PTO’S, worldwide media houses to get into the details of this memorandum.

The WP was not listed on the cause list. The Honorable court says it will be posted for hearing after vacation. I would receive the hearing date after 25-10-2023.
Activity on 26-10-2023
I presented a ‘memo for posting’ seeking immediate interim relief orders starting with prayer points Q, R, S and T. The WP is posted for hearing on 7-11-2023.
Activity on 7-11-2023
Honorable court stated that as a statutory requirement, the ‘Consent letter issued by the respondent’ is mandatory, to take further steps in this WP. Ordered to re-list this for hearing after the disposal of WP 12356/2023. I am waiting for the orders in WP 12356/2023. Once I have those orders, I will post this WP for hearing.
Hearing dates for WP 12356 / 2023
Despite my repeated attempts to be heard, and memo submissions for earlier posting for hearing dates to receive the Honorable court orders, the court dates have moved by, and I am still waiting for orders, according to facts, documented evidence, and Patent Cooperation Treaty. There might be schedule variance to the ‘Macro-reforms introduction, voting, and going live dates’ I have indicated in the Memo filed on 4-10-2023. I anticipate that the schedule variance would not be too much. I would need at least one month schedule notice, from Respondent upon Honorable courts orders, to hammer out the 200 slides presentation for Project Earthling(c), to be presented to 193 world countries at an upcoming WIPO assembly session.
Activity on 4-12-2023, for WP 12356/2023.
Appeared in front of the Honorable Chief Justice of Karnataka. Presented the facts related to court hearing for WP 12356/2023 on 24-11-2023. Honorable Chief Justice indicated that if the Judge / Court has issued orders, the WP will be routed to the other court conducting the IPR WP 13823/2023 proceeding. The registry will do the needful.

Activity on 9-1-2024
I filed the following ‘Memo for production of additional documents’ with the Honorable High court of Karnataka, which included annexures D1, D2, L1, L2, and P1. Annexure D2 is ‘Technical write up about patent us 8,910,998 B1, design shown in figure 4 of the patent which was used by uspto to fabricate prior art in fabricated ISR, annexure H. It includes Technical write up about PCT international application PCT/IB2016/050994, and includes graphs related to energy savings from exemplary application of thermal insulation, and hence the estimated sale price of the patent rights across 62 world countries’. It includes POV FE 2 and POV FE 3. Most importantly, it includes a section on ‘Legal facts and legal statements related to the resolution of breach of PCT articles, and execution of 62 sale agreements’. I request everyone to read this memo in detail.

I got time to introduce annexure D remittance and acceptance of 7.5 years maintenance fee for patent us 8,910,998 B1, annexure D1, annexure L1, annexure L2, annexure P1, annexure L, annexure M, annexure M1, and annexure J1, to the Honorable court, and present the documented evidence for my prayer in the Writ petitions. I will be presenting more annexures, documented evidence, and evaluation of the sale price related details, including annexure D2, in the upcoming hearing date. The honorable court posted the Writ petition for ‘hearing and orders’ to 25-1-2024. According to Honorable courts orders dated 5-12-2023, both the Writ petitions are connected.
Activity on 25-1-2024
The afternoon session of the court started at 3:50pm. I got the hearing time to present annexure J, annexure K, and most of annexure D2. I presented the technical details regarding manufacturing the two layer integrated fluid tight space design, shell design, figure 4 in patent us 8,910,998 B1, using extrusion machines, and why uspto went after that design to fabricate prior art cobb and price. The technology is ready to be embraced by automotive production plants across 62 countries, in the PRESENT. The technical details related to the PCT international application PCT/IB2016/050994, the TI factors related to the exemplary ‘Thermal insulation’ application were presented, and that the technology is in the PRESENT to realize energy savings right now, and that the savings are perpetual. I introduced the two graphs attached in annexure D2, and how the estimation of the sale price for patent us 8,910,998 B1 across 62 world countries was evaluated by me and how I chose the conservative sale price number of 93 Trillion Earthlings as the cumulated liability to be paid to me, into my bank account in INDIA. Introduced RBI regulations, in me receiving the liability payout, and hence the introduction of the Macro Economic reform Project Earthling(c) to 193 world country delegates at WIPO in a 24 hour event was of high priority, and indicated that it is extremely important reform for the world countries that should have gone live 250 or 300 years ago. With all the documented evidence presented, I requested orders for prayer in WP 12356/2023, and prayer point F, and Interim prayer points R, S, T of WP 13823/2023. While I wanted to get some more hearing time for presenting other annexures after receiving these immediate orders today, the Honorable court moved in the direction of issuing ‘Judgement’ for the Writ petitions. And stated the Judgement would be issued in few days, within next week. The Honorable court indicated all the prayer points would be reviewed and addressed in Judgement. I look forward to reading the Judgement in detail, and continuing the next steps, to get the 62 sale agreements executed, and initiate the ‘original suit’ against uspto. Towards the end, I had to mention to the Honorable court that in WP 4851/2023, the usa sale agreement was prayed to be executed in usd, as an interim pay to be exchanged to Earthlings later, and that is modified in WP 13823/2023, in which the prayer is for executing all 62 sale agreements including usa agreement in EARTHLINGS currency.

I requested few minutes of the Honorable courts time to provide my statements, my response to the two page side-by-side comparison of prayer points of WP 4851/2023 and WP 13823/2023 given to me by respondent on 25-1-2024. The Honorable court suggested that I file a memo to file my response.

Activity on 4-3-2024
Since the Writ Petitions were posted for orders on 25-1-2024, and after waiting for over a full month, I appeared in front of the Honorable court, CH-29, given the roster change that took effect, end of February. The Honorable court provided direction that if Writ petitions were marked ‘Heard, orders reserved’, the court / Justice that heard the petitions will issue orders. And if they are not yet issued, then I must wait. So, I am still waiting for the orders to be issued by the Justice that heard the writ petitions, Justice C.M. Joshi. In the roster change that took effect, he is delivering Justice on Kalburgi bench. He was not presiding in CH-6, on 4-3-2024.

Since the orders in WP 12356/2023, and Interim orders in WP 13823/2023 are yet to be issued, I filed the following ‘memo for production of additional documents’, with the Honorable court for WP 13823/2023, Intellectual Property Rights classification. This memo is to provide legal statements, legal documents, status, and updates to some of the relevant annexures. It includes annexures O1, U1, W2, and EE1. I request everyone to read these annexures in great detail.

I filed the following ‘Memo for production of additional documents’, with the Honorable court for WP 13823/2023, Intellectual Property Rights classification. This memo includes annexures M2, Q1, EE2, and FF. I request everyone to read this memo and all the annexures in great detail. Upon receipt of orders, I am ready to file the ‘Original Suit’ with the Honorable court.

In accordance with the documented evidence, and Patent Cooperation Treaty, I requested the orders of the Honorable court, for WP 12356/2023, for respondent to issue the ‘Consent letter’ to address the legal requirement of CPC section 86(1), so that I could file the ‘Original Suit’ at the Honorable High court of Karnataka. Further, requested the Honorable court to issue the necessary Interim relief orders for WP 13823/2023, and that it be adjourned until the time for ‘Execution of 62 sale agreements’. I indicated to the Honorable court that I am ready to file the ‘Original Suit’. The Honorable court posted the Writ Petitions for orders by next friday, 14-6-2024.
